GALLIPOLIS — The case against a Gallipolis woman accused of sexual misconduct with a juvenile has been resolved, according to information filed this week with the Gallia County Clerk of Courts Office.

An entry filed on Monday and signed by Common Pleas Judge D. Dean Evans states that the court has been advised that the case against Autumn L. Alban-Beaver has been resolved and a plea agreement will be presented to the court within the next seven to 10 days.

A hearing on pending motions in the case was held on Friday, according to the entry. Present during the hearing were Angela Canepa and Leigh Bayer, special prosecuting attorneys with the Ohio Attorney General’s Office on behalf of the state of Ohio, and K. Robert Toy, of Athens, attorney on behalf of the defendant.

Beaver, 29, of Gallipolis, was indicted in April of this year and, soon thereafter, appeared for an arraignment hearing, pleading not guilty to five counts of unlawful sexual conduct with a minor, all felonies of the third degree; one count of the illegal use of a minor in nudity-oriented material or performance, a felony of the fifth degree; and one count of disseminating matter harmful to juveniles, a misdemeanor of the first degree.

According to the indictment, filed and signed by special prosecutor Canepa, between June 1, 2013, and Aug. 31, 2013, Beaver allegedly engaged in sexual intercourse with the victim, who was 13 years of age, but less than 16 years of age at the time of the incidents. The indictment also alleges that the defendant possessed or viewed material that shows the victim, as well as disseminated to the victim material that is harmful to juveniles.

During her arraignment hearing in April, the defendant’s bond was set at $75,000, own recognizance, with an additional $1,500, 10 percent bond.

As a condition of her bond, the defendant was ordered to have no contact with the person or property of the victim in this case.

Following her hearing, bond was posted for Beaver’s release from the Gallia County Jail.

It is expected that the defendant will appear in the common pleas court for a plea agreement hearing within the week.
