Ex-city employees settle suit

POINT PLEASANT — A settlement has been reached in a lawsuit against the city of Point Pleasant and a former mayor by three one-time employees who claimed they lost their jobs due to political reasons.

Harriett Nibert, Heather Moore and Brook Kapp (Denny) were ready to take their case to trial in Mason County Circuit Court on Wednesday, but instead, a settlement of their suit resulted.

Details of the settlement will be available when the action is filed with the Mason County Circuit Clerk’s office. However, WSAZ-TV reported one of the plaintiffs said they would share $250,000 as part of the agreement.

In the suit against the city and former mayor Marilyn McDaniel, Nibert, Moore and Kapp (Denny) said they were informed in a July 1, 2007, letter from McDaniel — who had been elected mayor that May — that their positions had been eliminated by city council. In court documents, it was noted the majority of council members were Republicans.

Nibert was the executive secretary in the mayor’s office, Moore was the city’s finance and human resources director, and Kapp (Denny) was manager of the city water office.

McDaniel, a Republican, defeated incumbent James Wilson, a Democrat, in the 2007 municipal election. McDaniel resigned as mayor the following March, citing personal reasons.
